I.- PURPOSE AND SCOPE

These stipulations aim to regulate the use of electronic sales services for the various goods and services offered by ESBOZOS TOT EN ART, S.L., a commercial company operating via its website en.totenart.com, selling products and services related to Fine Arts.

The clauses in these General Conditions bind both parties and form an integral and inseparable part of the sales contract, which becomes effective when the client places an order through the mechanisms specified below, in accordance with Article 1,255 of the Civil Code, which establishes the principle of freedom of contract. For all purposes, the client/user is considered to accept these conditions if they tick the box "I have read and fully accept the terms of use." during the purchase process.

To fully protect the rights of consumers and users of ESBOZOS TOT EN ART, S.L.'s purchasing service, these General Conditions are established in accordance with Spanish laws, including Law 26/84 of June 19, Law 7/98 of April 13, Law 7/96 of January 15, the Civil Code, EU Directive 2000/31/EC, Law 34/2002 of July 11, and other applicable regulations.

ESBOZOS TOT EN ART S.L., as a provider of online sales services, has its registered office in Spain at C/ Corona 35 B, Valencia, registered in the Valencia Mercantile Registry, Volume 7875, Book 5169, Page 206, Sheet V-98417, Entry 1ª, with tax ID CIF B97488019.

It provides online sales services through the website: “http://en.totenart.com”. For complaint purposes, the company’s registered office is considered the official address.

III.- PURPOSE

These General Conditions regulate the provision of sales services, contracting of products and services offered by ESBOZOS TOT EN ART, S.L., and advertising directed at clients/users via the website, as well as the rights and obligations of the parties arising from concluded sales transactions. In certain cases, the client may opt to pick up a specific item at ESBOZOS TOT EN ART, S.L.’s premises, provided prior notice is given via phone.

IV.- INTELLECTUAL AND INDUSTRIAL PROPERTY

Rights relating to industrial and intellectual property (including, but not limited to, trademarks, logos, texts, photos, icons, images, graphic design, source code, and other software elements contained on https://en.totenart.com) belong to ESBOZOS TOT EN ART, S.L. or the wholesalers/manufacturers of the offered products and services. These rights are protected under Spanish and international law.

Without prior written authorization from ESBOZOS TOT EN ART, S.L., or the rights holder, it is not permitted to use, reproduce, transmit, manipulate, or otherwise exploit the content, except for normal and necessary personal use of the website. Accessing the services does not imply renunciation, transfer, or assignment of intellectual or industrial property rights, nor does it confer rights to use, alter, reproduce, distribute, or publicly communicate the content without explicit written consent.

ESBOZOS TOT EN ART, S.L. authorizes links from other websites provided that:

V.- OFFER AND ACCEPTANCE PROCESS, TERMS OF PURCHASE, SALE, AND DELIVERY

Pricing policy: ESBOZOS TOT EN ART, S.L. reserves the right to unilaterally change the prices of products and services on its website at any time. Published prices include VAT and shipping costs.

Orders are shipped freight prepaid for Spain, Andorra, and Portugal. For other European countries, shipping costs will be calculated per order based on volume and destination.

Payment methods:

  • Prepayment: bank transfer to ESBOZOS TOT EN ART, S.L.’s account as published on the website.
  • Credit card: payment at the time of order.
  • Cash on delivery: payment in cash upon delivery, with an additional fee.
  • PayPal: payment at the time of order.
  • Financing: subject to approval by the financial institution.

Invoice: A physical or electronic invoice will be sent after payment.

Delivery time: indicative only; delays over 20 days allow the client to unilaterally cancel the order, with reimbursement of prepaid amounts.

Delivery: to the address provided by the client. The carrier will include the order details, price, quantity, and products. If the client detects errors or visible damage, they must report them within 24 hours.

VII.- PRODUCT WARRANTY

Standard warranty: 2 years. Full warranty during the first week for defects (return and replacement of the product). After this period, the client bears shipping costs for servicing. Warranty is limited to manufacturer defects.

To claim the warranty: present purchase invoice and complete packaging including manuals and controls.

VIII.- CLIENT RIGHTS

  • Confidentiality and security of personal data according to Spanish law.
  • No disclosure without express consent.
  • No marketing emails without consent.
  • Consult, modify, or delete personal data on request.
  • Free access to open sections of the website.
  • Know the status of the order at all times.
  • Right of withdrawal under Article 44 of Law 7/1996.

IX.- USER/CLIENT OBLIGATIONS

  • Keep personal login credentials secure.
  • Use published information only for intended personal commercial relationship.
  • Do not reproduce, sell, or manipulate content without permission.
  • Use the purchase service properly and avoid interference or malicious acts.
  • Respect the purchase agreement and payment obligations.

ESBOZOS TOT EN ART, S.L. is not responsible for interruptions in electricity or telecommunications preventing clients/users from using the services.

XIII.- CONTRACT LANGUAGE

The contract may only be formalized in Spanish.

XIV.- APPLICABLE LAW AND JURISDICTION

These General Conditions are governed by Spanish law. Any disputes will be resolved in the courts of Valencia, waiving any other jurisdiction.
